Amid the ongoing controversies surrounding the swearing in of Bola Ahmed Tinubu as the president of federal republic of Nigeria on the 29th of May. A Senior Advocate of Nigeria, Wahab Shittu has come out to explain why he thinks that the election petitions tribunal can make and order to Restrain chief justice of Nigeria (CJN) from swearing Bola Ahmed Tinubu in.
Wahab Shittu made this explanation few hours ago while being interview on TV360.
Quoting Wahab Shittu’s statement during the interview, he said; “This suit is a gross abuse of court processes. I am saying this for the following reasons; First of all, we know that the declaration of Asiwaju Bola Ahmed Tinubu as president-elect is already a subject of litigation before the Presidential Election Tribunal. As such, if there is any court of competent jurisdiction that can make an order to restrain the Chief Justice of Nigeria (CJN) from swearing Tinubu in, it is the Election Petitions Tribunal, not the Federal High Court”.
Speaking further, Wahab Shittu said; “Secondly, the High Court of the FCT is an inferior court when it comes to election matters of this nature. It is inferior to the Presidential Election Tribunal which is also known as the Court of Appeal. So, if these persons wanted to file any lawsuit regarding the election, they should have done so at the Tribunal. But even that can not be possible because these people are not candidates, neither are they representatives of a political party. So, this is why I said the lawsuit is a gross abuse of court processes.”
