Kogi Governoship:Supreme Court Set To Hears Petition Over Exclusion of DPP Vs Gov. Bello, APC

 
The Supreme Court sitting in Abuja would on Tuesday next week deliver Judgment in the petition by the Democratic Peoples Party (DPP) against the judgment of the Appeal Court which had earlier dismissed their election petition.
The DPP had challenged the November Governoship Kogi State Election, stating that the party was unlawfully excluded.
It would be recalled that the Court of Appeal had ruled against DPP holding that the party could not prove elementary facts such as the valid nomination of their so-called candidates or even that they held a valid Primaries at all.
The Court of Appeal therefore refused to interfere with the findings of the Tribunal and held that the judgment of the Tribunal is affirmed and appeal is dismissed.
But the recent Bayelsa Governoship Election Tribunal which nullified the Bayelsa Governoship Election on account of the lawful exclusion of the ANDP has however raised fears in certain quarters, and rekindled the hope of the DPP of likely victory, has also kept residents on the edge since the notice of hearing was released by the Supreme Court.
The hearing notice is in suit SC 435/2020: Democratic Peoples
Party V. Bello Yahaya & 3 ors and stated as follows:
TAKE NOTICE that the above Appeal will be listed for hearing before the Supreme Court of Nigeria on Tuesday the 25th day of August, 2020.
AND FURTHER TAKE NOTICE that in accordance with the Supreme Court Rules, this Notice is deemed sufficiently served on you if it is delivered on your Information and Communication gadgets.
FURTHER TAKE NOTICE THAT COVID-19 PROTOCOLS shall be fully and strictly enforced. It’s only the Counsel who are appearing and whose name are entered in the Counsel List (NOT MORE THAN 5 Counsel per Appearance) will be admitted into the Court and NO MORE.

The recent precedence of the Supreme Court hearing and delivering Judgement same day, has made the people of Kogi State very apprehensive of what the outcome would be on Tuesday.
For now it is a mixture of anxiety, expectations from all camps as the apex Court would hear and possibly decide on all the three petition in the supreme Court on Tuesday.
