Nigeria’s Federal Competition and Consumer Protection Commission has issued regulations to provide guidance on assessing abuse of dominance and clarifying the process for exception based on pro-competitive and efficiency gains.
The regulations are sophisticated, contemporary and nuanced. The FCCPC is barely 4 years since it began operation, yet the regulation demonstrates a level of innovation, and provides unusual clarity and predictability. The regulations should be particularly helpful as a template for authorities in countries whose competition law draws in part from the competition law of the European Union, and for developing countries.
