A High Court of the Federal Capital Territory on Thursday stuck out two motions filed by the Ganduje-led faction of All Progressives Congress, APC.
On November 30, Justice Hamza Muazu granted all the reliefs sought by the ex-Governor Ibrahim Shekarau-led faction, seeking a declaration that Ganduje-led group did not conduct ward congresses.
Dissatisfied with the decision of the court, the Ganduje-led faction filed a motion seeking the court to stay proceeding and set aside its decision on the ward congress.
Delivering the ruling on December 17, 2021, the judge dismissed their motion and fined them N1million for filing frivolous and time-wasting motion.
But before the court takes a decision on two motions for setting aside the judgment and stay of execution on local government congress, the Ganduje-led faction appealed its case and transmitted records to Court of Appeal.
Ruling on the case on Thursday, the judge struck out the applications on the basis that the records were transmitted to the appellate court, and therefore has no jurisdiction to entertain the matter.
The Court of Appeal is expected to decide on the case within 60 days.
